IT for Change submitted its feedback/comments on the draft amendment to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 ("IT Rules") relating to synthetically generated information released by the Ministry of Electronics and Information Technology. Our submission highlighted two key issues of the proposed amendment:
(i) Labeling and user declarations as mandated by the proposed amendment are not adequate to address the virality of synthetically generated content
(ii) IT Rules cannot be a substitute for a comprehensive governance framework for AI
We recommended additional due diligence measures for significant social media intermediaries and called for a comprehensive regulation on AI services, especially content-generating AI services such as text and image generators.
